Terms & Conditions

The following terms and conditions apply to all orders for the purchase of services from Pisces Training UK Ltd.

We advise you to print off and keep a copy of these terms and conditions for your records a copy is sent with every invoice.

These terms and conditions do not affect your statutory rights.

Definitions

“Model Cancellation Form” means the model cancellation form of the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, included at the bottom of these Conditions;

“Personal data” shall have the meaning set out in the Data Protection Act 1998;

“Service(s)” means all course(s) offered by Pisces Training UK Ltd;

“We/us” means the Pisces Training UK Ltd  (a company incorporated in England and Wales (number 7682710) whose registered office is at The Tangent Business Hub,Weighbridge Road, Shirebrook, Mansfield, Notts NG20 8RX

“Website” means www.piscestraining.co.uk and

“Client” or “You” means the purchaser of services from the Pisces Training UK Ltd.

Confirmation

Confirmation of the booking from the client via either telephone or an open course or Onsite booking form implies acceptance of these Terms and Conditions.

Any provisional telephone requests for training or orders must be confirmed on our booking forms on the website as directed when making the telephone request within seven days of first contact or via a booking form posted out by us & returned within seven days of postal date. However, as above, such telephone bookings will be considered as confirmed unless specifically cancelled in writing by Post or E Mail within 7 days of the original telephone booking.

After placing an Order with us via our website, you will receive an e-mail from us acknowledging that we have received your order. Please note that this does not mean that your order has been accepted. Your order is confirmed once you receive either an email with an invoice & terms & conditions attached or it is sent via Royal Mail to the invoice address unless we are otherwise directed to send to an alternative address on the booking form

Our Status

By placing an order with us by telephone, letter, or via our Website, you warrant that:

  • You are legally capable of entering into binding Contracts
  • You are at least 18 years old.

Payments

An invoice along with a copy of the terms & conditions will be issued upon confirmation of your booking, and the total is to be paid within 30 days from the date of the invoice or before the course start date, whichever is soonest unless a prior agreement has been made with Pisces Training UK Ltd. Pisces Training UK Ltd will not accept cheque or card payments on the day of any course start any payment made on the start day of the course must be in cash only.

We reserve the right not to carry out training where the invoice has not been settled before the course begins unless a prior agreement has been agreed.

We reserve the right (under Late Payment of Commercial Debts (Interest) Act, 1988) to charge the customer on any overdue amount at the rate of 8% per month, compounding monthly.

In the event of fewer students attending a course than had been booked, or the client cancelling anyone booked (within the cancellation terms period) the client will still be charged for the class size rate they originally requested.

CERTIFICATES WILL NOT BE ISSUED UNTIL INVOICES ARE PAID

By Post

Make your cheque payable to Pisces Training UK Ltd, cross it A/C Payee only and write your invoice number on the back.  Post payment to:  Pisces Training UK Ltd, The Tangent Business Hub, Weighbridge Road, Shirebrook, Mansfield, Notts, NG20 8RX.  Cheque & Card payments must be made a minimum of 7 working days before the course start date.

We do not accept post-dated cheques or American Express and cheque & card payments will not be accepted at the start of any courses.

 PLEASE DO NOT SEND CASH VIA POST

By Card

Card payments are accepted via the telephone only and will not be accepted on the first day of any course as funds have to cleared into our account by the start of the course. We cannot accept American Express card payments.

On Site Training

Access to suitable parking at the venue will be needed for the instructor.  If this is not available we need to be informed at least seven days prior to the start date, as it will affect the amount of equipment the instructor can bring.

If parking meters or paying car parks need to be utilised the client will need to provide payment.

The instructor will provide all equipment they need to teach the course, unless otherwise agreed or parking close to the venue cannot be allocated.

The training/assessment venue must be suitable for the purpose (i.e. – no interruptions, appropriate environment, sufficient, space carpeted floor for first aid courses etc.).

Our instructors are under strict instruction to terminate any training where they believe their personal safety or health & safety may be at risk and in such cases any company will still be liable for all outstanding fees without exception.

We will always prosecute persons who threaten or assault our staff.

Mileage Charges

There is no charge for the first fifty miles after that a mileage rate of 35p per return mile will be charged. If any congestion fees, parking meters or paying car parks or hotels need to be utilised the client will need to provide payment for these. The mileage is worked out by using the RAC’s Route Planner.

Cancellations & Amendments

ALL CANCELLATIONS MUST BE IN WRITING EITHER BY EMAIL OR POST.

Consumer Cancellations

If you are booking as an individual & not as a company the following applies:

Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013,

If you are booking as an individual, you have 14 calendar days in which to cancel your booking from the date it was made. If your course is due to start within this 14 calendar day period:

If we have fully supplied the first aid course, you will lose your right to cancel and not be entitled to any refund of the fees you paid.

If we have supplied only part of the course, you are still able to cancel the remaining part(s) of the course(s), but will be liable for the supply of all service(s) we have provided to you up until the time we receive notice of your intention to cancel. This will be calculated as an amount proportional to the services that have been supplied, taking into account the total cost of the course. This applies to scheduled open courses plus any booking by a consumer for 2 or more people on an open course. Cancellations can be made via the Model Cancellation Form, at the end of these terms & conditions under Right to Cancel, via email (betty@piscestraning.co.uk) or using Royal Mail to send a letter.

If the client cancels a course or a place on an open course after the 14 days, or if a company cancels after booking they will be liable to a cancellation fee if the cancellation is within the following time frames.

This is charged on the following sliding scale:

25% of invoice total if cancelled within 15 – 21 days of course start date including Weekends.

50% of invoice total if cancelled 8-14 days of course start date, including Weekends.

100% of invoice total if cancelled within 7 days of course start date, including Weekends.

Companies/Individuals who fail to cancel within this time will be liable for full payment of all fees due without exception.

Pisces Training UK Ltd will also require full payment of all course fees due without exception for individuals that are absent without notice from any course.

If we have to cancel a course we will give as much notice to the client as possible.  Clients will be offered an alternative mutually agreeable date for training in the first instance.  If no agreement can be reached Pisces Training will issue a refund to the client.

We retain the right to alter, amend, change or adjust any course profile as is deemed appropriate without notice.

Data protection

Pisces Training UK Ltd will use the information you provide on your booking form, and additional information you may provide on course paperwork such as exam papers, for administering our training courses and for our Awarding Bodies where necessary, i.e. where exam papers have to be sent to the Awarding Body for that course.

We will not disclose this information to any other person or organisation other than Awarding Bodies when required for exam purposes.

Right to Cancel

Model instructions for cancellation for Individuals

You have the right to cancel this contract within 14 of days of booking without giving any reason.

The cancellation period will expire after 14 days from the day of the conclusion of the contract.

To exercise the right to cancel, you must inform the Pisces Training UK Ltd, The Tangent Business Hub, Weighbridge Road, Shirebrook, Mansfield, Notts. NG20 8RX (email: betty@piscestraining.co.uk) of your decision to cancel this contract by a clear statement (e.g. a letter sent by post, or e-mail). You may use the attached model cancellation form but this is not obligatory.

To meet the cancellation deadline, it is sufficient for you to send your communication concerning your exercise of the right to cancel before the cancellation period has expired.

Effects of cancellation

If you cancel this contract, we will reimburse to you all payments received from you. We will make the reimbursement without undue delay, and not later than 14 days after the day on which we are informed about your decision to cancel this contract.

We will make the reimbursement via a bank transfer, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of the reimbursement.

If you requested to begin the course [the performance of services] during the cancellation period, you shall pay us an amount in proportion to the amount of the course you have attended [the services that have been performed] until you have communicated to us your cancellation from this contract, in comparison with the full cost of the course [the coverage of the contract].

If you would like Pisces Training UK Ltd to start work during the cancellation period which is within the next 14 days, we require you to complete and sign the notice below confirming that you wish us to do so otherwise we are unable to commence work or provide services within 14 days of your receipt of this notice.

I require Pisces training UK Ltd to commence work within 14 days.

I do not require Pisces training UK Ltd to commence work within 14 days.

I am aware that I will be liable to pay for the services accordingly.
